The Turkish Grand National Assembly (TBMM) recently approved a key judicial reform package known as the Yargı Düzenlemesi. This reform package has been in the works since August 2019 and was put forth by the ruling Justice and Development Party (AKP) as part of its ongoing efforts to address the country’s judicial system.

The Yargı Düzenlemesi contains several key provisions that are aimed at improving the independence of the judiciary, reducing the workload of judges and prosecutors, and enhancing the transparency of the legal system. Some of the notable provisions of the reform package include:

– The establishment of a new Council of Judges and Prosecutors (HSK) that will be responsible for the appointment, promotion, and discipline of judges and prosecutors. – The creation of specialized courts and prosecutor’s offices to handle cases related to terrorism, organized crime, corruption, and cybercrime. These new institutions are intended to reduce the workload of regular courts and prosecutors and improve the efficiency of the legal system.

– The introduction of new rules for the handling of digital evidence and the use of technology in court proceedings. These rules are aimed at facilitating the processing of evidence and improving the speed and efficiency of trials.

The Yargı Düzenlemesi has been praised by some as a long-overdue reform that will help to strengthen the rule of law in Turkey and enhance the country’s international standing. However, some opposition lawmakers and legal experts have raised concerns about certain aspects of the package, including the composition and powers of the new HSK and the potential for political interference in judicial appointments.

Despite these concerns, the AKP’s parliamentary majority ensured that the Yargı Düzenlemesi was passed by the TBMM, with 288 votes in favor and 107 against. The package is now awaiting approval by President Recep Tayyip Erdogan, who has expressed his support for the reform package and is expected to sign it into law in the coming weeks.

Overall, the Yargı Düzenlemesi represents a significant step forward in the ongoing process of judicial reform in Turkey. While there are still some concerns and challenges that need to be addressed, the reform package has the potential to improve the efficiency, transparency, and independence of the Turkish legal system, and to help build a stronger, more stable democracy in the country.
